The judges definitely can if they interpret to be constitution and their argument is warranted. That's the nature of the judiciary. If there is no body that decides what is constitutional and not constitutional, then the writings are meaningless and the entire process turns into noise.
I think his point is that the people super-cede the judicial branch.
Which people, Josh? The communists? The Social Democrats? The Libertarians? The Anarchists? The Christian Conservatives? The etc... You see, this is the problem. And, yes, the people super-cede judicial review when they pass legislation or an amendment, but that is not what we are talking about.
The people who decide to revolt.
